Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Surfaced (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using Surfaced on behalf of an organisation, you agree on its behalf.

The Service

Surfaced tracks whether AI assistants recommend a business for the prompts you configure, across multiple AI engines, and produces reports you can share with your clients. Results reflect AI outputs at the time of each check and may vary between runs; we do not guarantee any particular ranking, placement or outcome.

Accounts

• You are responsible for the activity under your account and for keeping it secure.
• You must provide accurate information and keep it up to date.
• You must be authorised to add any brand, domain or client you track.

Plans, billing and trials

Paid plans are billed in advance on a recurring basis through our payment processor. Free trials convert to paid plans unless cancelled before the trial ends. Plan limits — such as the number of projects and active prompts, and white-label availability — apply as described on our pricing page. Fees are non-refundable except where required by law.

White-label use

On eligible plans you may present reports under your own brand to your clients. You remain responsible for your client relationships, for the accuracy of any claims you make using Surfaced data, and for compliance with applicable law in how you resell the Service.

Acceptable use

• Do not use the Service to break the law or infringe others’ rights.
• Do not attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.
• Do not submit prompts intended to harass, deceive or generate unlawful content through the connected AI engines.

Third-party AI engines

The Service relies on third-party AI providers to run checks. Their availability, behaviour and outputs are outside our control, and your use of those outputs is at your own discretion.

Intellectual property

We own the Service and its underlying software. You retain ownership of the brands, prompts and client data you submit, and grant us the limited rights needed to operate the Service and produce your reports.

Disclaimers and liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. On termination, your right to use the Service ends; certain provisions survive by their nature.

Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.
